Customers.Motor scooter or moped sales on this site are limited to those who are over 18 years of age and who are residents of the United States. Purchaser certifies that he/she is at least 18 years of age. Warning: Motor scooters or mopeds are not for use for children under 16 years of age. Purchaser understands the nature of motor scooter or moped riding and motorcycle activities. Purchaser also agrees to assume all risks when operating or allowing others to operate your motor scooter or moped. If you are not familiar with the nature of motor scooter or moped riding, you should seek professional training before operating a motor scooter or moped. Purchaser also acknowledges that motor scooter or moped riding is inherently dangerous and hazardous, and that use of the motor scooter or moped involves the risk and danger of serious bodily injury including, but not limited to, disability, paralysis, dismemberment and death. Additional risks may exist that may not be readily foreseeable. The operator must obey all state laws and use reasonable care whenever using or driving the Motor scooter or moped or Moped. We advise you always wear a DOT approved helmet and other safety clothing whether or not these are required by the laws in your state.
State and Local Laws. Motor scooter or moped laws vary from state to state. They are updated frequently. You are solely responsible for determining the legality of your motor scooter or moped in your state. ScootsUSA will not issue any refunds based on claims of unsatisfactory legal status. ScootsUSA has provided links to state DMVs on this site. ScootsUSA will provide a bill of sale and a Manufacturer’s Certificate of Origin, referred to as a MCO (similar to a title). Unless specified, our motor scooters or mopeds are U.S. Department of Transportation approved and in many cases EPA approved as well. ScootsUSA can make no representation that the motor scooter or mopeds are street legal or legal for operation in your locale. Check your local laws before purchasing and operating motor scooter or mopeds.
Taxes & Fees: We do not charge taxes for any shipment outside of Virginia. You may be charged taxes if you register your product for license plates or tags. All states are different; consult your local tax collector for full information. Out of state buyers are responsible for all state, county, city taxes and fees, as well as title/registration fees if required in the state that the vehicle will be registered
Sale of Motorcycles: Vehicles with engine sizes greater than 50cc are sold directly through Verucci Motorcycles d/b/a Qingqi USA, or Lance Powersports or others. These companies, directly, will act as the dealer in these cases. MCO and warranty terms will be supplied directly by them and may not be the same warranty as offered by ScootsUSA for its motor scooters under 50cc.

Assembly. Minor assembly is required on all of our scooters. How much assembly depends on the scooter you purchase. The Avispa model for example comes almost fully assembled (you have to add mirrors and battery). The Challenger requires more work (front tire, front brake, mirrors, handlebar, battery). We provide instructions on how to do the assembly (PDF files can be found in our DOWNLOAD section on this website) AND we are available via phone or email to answer questions you may have with regard to assembly. Regardless of the model you purchase, before you can safely operate your motor scooter you will need to carefully and thoroughly go over your motor scooter to make sure everything is in order. This includes adding fuel, checking oil levels, adjusting mirrors, checking brakes, checking air pressure in the tires and tightening all nuts/bolts/screws which may have come lose in transit to you. It is important to understand that you are likely the first person to see or touch the scooter since it left the manufacturer in China. The long trip via cargo ship and then truck to your home often loosens bolts, screws and electrical connections. Please make a point to review "Prepping Your Motor Scooter" prior to receiving your motor scooter. This document and many other helpful reference documents can be found in our "Customer Only Area". We recommend having a motorcycle shop or motor scooter mechanic assemble/check the motor scooter if you are unfamiliar with this.

ScootsUSA's manufacturers offer a 12 month limited warranty on all Gas
Motor Scooters. This warranty covers factory defects and defaults only. We do not cover misuse or broken parts caused by the user, shipping or by any other event.
This warranty guarantees our vehicles from manufacture defects within the advertised warranty period from the date you receive your vehicle. Factory warranty periods may vary from vehicle to vehicle. Please see your vehicle description for detailed factory warranty periods. ScootsUSA or its representative, will service your vehicle under warranty at no additional costs. Buyers are responsible to ship or tow in your vehicle to our facility for any warranty service(s). Any outside repair labor charges, down time, towing or shipping charges are not covered under warranty.
The following are warranty limitations and exclusions:

Unauthorized outside repair
Improper maintenance and/or lack of maintenance according to service manual.
All scheduled maintenance must be documented by a certified technician.
Defective warranty part(s) are required to be returned to exchange for new replacement part(s). New replacement part(s) under warranty will be shipped to buyer at no additional costs. Returning your defective part(s) will ensure we send you the correct part(s) and assist us in monitoring and correcting potential manufacture defects.
For your safety and the safety of your family, any necessary assembly or maintenance must be performed by a certified technician in order for warranty to be valid. There may be unforeseen issues that require the expertise and knowledge of a trained professional. These issues include, but not limited to: electrical connections that have become disconnected in shipping, vacuum or fuel hose(s) dislodged in shipping and Loose nuts and bolts in need of tightening. While these issues are normally very simple to correct, most being a simple re-connection, they can be a nuisance and very difficult to troubleshoot without the proper knowledge.
Our first concern at ScootsUSA is your safety and satisfaction. These vehicles will be driven at high speeds and by children in some cases. These concerns are better preserved by having your vehicle properly assembled and inspected prior to use.
Damage that occurs during shipping and handling is not covered under our warranty.
Please contact us to help you process a claim directly with the carrier. If you are
not sure if your product was damaged through shipping, please contact us ASAP.
Often the manufacturer will cover damage to the body parts if it is damaged during
shipping reported within 2 days of receiving the scooter. If you have
a problem, just check with us to see if it is covered by contacting us right
away by phone or e-mail.
ScootsUSA is not responsible for the proper or improper use of merchandise
sold. We care about our customers and urge you to exercise caution and take
necessary safety measures to protect yourself while riding ScootsUSA scooters. Please try to make a habit of inspecting your motor scooter before each ride to assure tightened bolts, nuts, screws and check other safety items such as tire pressure, cables, brakes , etc.
THIS
LIMITED WARRANTY COVERS THE FOLLOWING PARTS:
ENGINE: Engine long block assembly, including all internal lubricated parts,
i.e. rings, pistons, pins, crankshaft and, main bearings, the connecting rods,
and rod bearings, camshaft bearings, timing chain gears, rocker arms, valve
springs, valve guides, valve seats, valve push rods, valve lifters, and oil
pump. Additionally, the engine head (s), engine block and cylinder barrels
will be covered if they are solely as a result of the mechanical failure of
one or more of the internal lubricated components specified above. The Cooling
system must be in good working order including cooling fans. Accessory items,
including but not limited to electrical components of all types (distributor,
alternator and all sensors and electrical control devices), fuel systems, gaskets,
seals, filters, mounts linkage and fluids are not covered by this agreement.
TRANSFER CASE: All internal lubricated parts contained within the transfer
case. The transfer case itself will be covered if damage solely as a result
of the mechanical failure of one or more of the internal lubricated components
contained within the transfer case. Accessory items, including but not limited
to, U-joints, electrical components, linkage, seals, gaskets, mounts or fluids
are not covered by this Agreement.
DIFFERENTIAL: All internal lubricated parts contained within the drive axle
housing case. The drive axle housing itself if damaged solely as a result of
the mechanical failure of one or more or the internal lubricated components
contained the drive axle housing. Accessory items, including but not limited
to, backing plates, all brake system components, cables, controls, linkage,
vents, pumps, U-joints, electrical controls, mounts, seals, gaskets, and fluids
are not covered by this Agreement.
TRANSMISSION : All internal lubricated parts contained
within the transmission case. The transmission case itself if damaged solely
as a result of mechanical failure of one or more of the internal lubricated
components contained within the transmission case. The Complete hydraulic system
must be flushed including integral transfer case, oil cooler, lines, and new
filter(s) installed Accessory items, including but not limited to, modulators,
governors, electrical controls, linkage, mounts, seals, gaskets, and fluids
are not covered by this Agreement.
COVERAGE AND LIMITATIONS:
IMPORTANT: We strongly recommend you have a professional mechanic (any small engine repair shop,
motorcycle shop, or local auto repair shop) assemble your new scooter and do
the prep work to assure your scooter is in good working condition or your warranty
is limited to 45 days only. You will need to provide proof of this when filing
a warranty claim, so please keep your receipts. You must also have a professional
mechanic work on your scooter to file a claim on the warranty.
Subject to the limitations stated in this agreement, the manufacturer agrees (at its
election) to replace a covered component if the covered component fails as
a result of one or more of the internal lubricated parts within the component
stated warranty period from the date of purchase, while the component is being
used under the conditions and in the manner specified by its original manufacturer.
REPAIRED COMPONENTS: If the components are repaired under
the terms of this Agreement they will be repaired or with components parts
of like kind and quality.
LABOR TO REPAIR OR REPLACE PARTS: ScootsUSA does not
pay for labor for the removal and replacement of such component (s) or part(s). In some cases the manufacturer may reimburse all or a portion of the labor depending on the make and model. In NO CASE will any labor reimbursed without prior written approval by the manufacturer.
IMPORTANT NOTES:
This warranty does not include labor, wearable
parts (battery, fan and fan cover, muffler, tires & inner tube, rims & wheels, brakes, light bulbs, speedometer cables, throttle cables, brake cables, drive belts, plastic parts included but not limited to fenders, covers, and other such plastic covers) or damaged parts from accidents, abuse, or shipping. If you have a part
that needs replacing, please contact us and we will send the part, usually within
5 days, or let you know the lead time for the part. In some extremely rare cases, the
parts may have to be shipped from overseas and may take up to 8 weeks for delivery.
All warranted parts must first be sent to our Parts Department, at the owners
expense, for inspection and testing for defects. Until the parts are sent to
us, replacement parts will not be sent under warranty.
Items and conditions that are specifically excluded from this warranty program
are:
Damage caused by accidents, misuse, negligence or improper vehicle operation.
Any modifications or alteration of any standard specifications or equipment.
Damage caused by failure to perform factory recommended service maintenance.
Damage which occurs as a result of improper storage. Damage caused by the use
of improper fuel or lubricants.
THIS AGREEMENT AND LIMITED WARRANTY IS VOID IF:
1. SCOOTSUSA IS NOT PROVIDED
A REASONABLE OPPORTUNITY FOR INSPECTION OF A COVERED COMPONENT PRIOR TO REMOVAL,
REPAIR OR REPLACEMENT OF ANY COVERED COMPONENT.
2. THE CUSTOMER DOES NOT USE A PROFESSIONAL MECHANIC (SMALL ENGINE REPAIR SHOP,
MOTORCYCLE SHOP, OR AUTO REPAIR SHOP) TO ASSEMBLE AND PREP THE SCOOTER PRIOR
TO OPERATION. PROOF OF THIS WILL BE REQUIRED (WITH A VERIFIABLE RECEIPT) BEFORE
PARTS WILL BE REPLACED. THERE WILL BE A 45-DAY LIMITED WARRANTY TO ANYONE
ASSEMBLING THEIR OWN SCOOTER.
3. THE COMPONENTS ARE NOT INSTALLED BY A CERTIFIED LICENSED REPAIR FACILITY
WITHIN 90 DAYS OF THE DATE OF PURCHASE.
4. THE DAMAGE TO THE COMPONENT IS CAUSED BY A NON-COVERED COMPONENT OR PART
OR BY ANY PART OR COMPONENT NOT PURCHASED FROM SCOOTSUSA OR DIRECTLY FROM THE MANUFACTURER.
5. THE CUSTOMER FAILS TO FOLLOW THE MINIMUM MAINTENANCE AND BREAK-IN REQUIREMENTS
SUGGESTED BY THE MANUFACTURER, AND/OR FAILS TO PROVIDE PROPER SERVICE DOCUMENTS.
Limited Warranty Transferability
WARNING! PLEASE NOTE: Purchaser understands the nature of motor scooter riding and related activitiesinvolve the risk and danger of serious bodily injury including, but not limited to, disability, paralysis, dismemberment and death. These inherent risks and dangers may be caused by purchaser's own actions or inactions, the actions or inactions of others, participating or not participating in the activity, the condition in which the activity takes place and or the negligence of others. There may be additional risks, including social and economic loss, either known or unknown to purchaser, not readily foreseeable. Purchaser agrees to fully accept and assume full responsibility for all such risks, losses, costs, and damages incurred as a result of Purchasers participation in scooter riding activity. Purchaser agrees to hold ScootsUSA (and its' related companies) harmless in any action with respect to liability foruseor operation of motor scooters or mopeds purchased from ScootsUSA. If Purchaser is not familiar with the nature of motor scooter or moped riding, purchaser should seek professional training before operating a scooter.
Your Scooter or Moped is designed for operation on paved surfaces. They are not intended for off-road operation unless that fact is specifically stated in writing at the time of sale.
This states all warranties applicable to your Scooter or Moped. ScootsUSA gives no other warranties, either expressed or implied, including fitness for any use intended other than as stated in the enclosed documents. All of buyers remedies are limited to those stated in the enclosed documents. Use of the Scooter or Moped in any manner other than as stated in ScootsUSAs enclosed documents voids any warranty by ScootsUSA. Oral representations by any sales representative as to the performance, safety or use of the Scooter or Moped are not warranties and are not representations authorized by the company if they are inconsistent with the writing in the enclosed material.
All disputes and claims for economic or physical damages are governed by the laws of the Commonwealth of Virginia. All law suits and legal actions must be brought in either Fairfax County, Virginia or in the United States District Court for the Eastern District of Virginia, Alexandria Division.
Shipping. Before we can ship, we process your order to verify availability of your product(s), shipping selections and credit card information. Most orders are shipped within 3 business days of receiving your order, however no orders are shipped on Saturdays, Sundays or holidays. In the event of delays or backorders, we will try to reach you by phone or email. If the delay is due to a back order, you will receive notice by phone, e-mail or mail and be given the choice to remain on back order, substitute another item, or cancel your shipment. Shipping is estimated to be 2-10 business days, after your order is processed, depending on your location. ScootsUSA uses traditional freight companies for delivery (typically FedEx Freight). ScootsUSA cannot be responsible for delays in shipping.
Damaged on Arrival. It is critical that you inspect the unit(s) prior to the delivery company leaving to insure no damage occurred during transportation. If a product is damaged in transportation we will assist you in your claim against the shipping company. It is critical that you inspect the unit(s) prior to the delivery company leaving to insure no damage occurred during transportation. If the delivery company leaves before you inspect, you may be denied the claim by the freight company. The claim is between you and the freight company. Digital pictures will help. Take several pictures of the carton and the damage if a digital camera is available. If you receive a carton that is visibly damaged, please note the damages on the shipping receipt. Be sure to obtain a copy. Keep the original carton and all materials and parts intact.
Order Cancellation. We strive to process your order the next business day. Cancellations within 24 hours if prior to shipment, will be accepted with no charge. After 24 hours, cancellations are not permitted. If shipment is refused, shipping costs (both ways) and a 15% restocking fee will be charged.Once ordered and processed, it cannot be canceled and shipment cannot be stopped.
Refunds or Returns. ScootsUSA wants you to be satisfied with your purchase. But there is a strict no cancellations, refunds, no returns policy. Our products are guaranteed to perform as described and there are thousands and thousands of satisfied users. Rest assured that if any defect should be found within the warranty period, ScootsUSA will repair or replace the item according to the warranty specifications. You are solely responsible for determining the legality of your motor scooter or moped in your state. ScootsUSA will not issue any refunds based on claims of unsatisfactory legal status.
Performance Parts & Upgrade Kits. Disclaimer: ScootsUSA makes these parts available to you because many of our customers have requested them. Using them requires knowledge of how a cvt transmission works. Since small modifications cause big changes and many variables are involved; we will not offer any technical assistance for parts listed in the Parts and Performance Parts sections. If you are not sure that you can install and adjust your transmission for maximum performance, do not purchase these parts. Thank you for your understanding. Please note: high performance parts carry no warranty, period! All high performance parts are for off-road use only and are not intended for legal street use. Use of any of these parts on public highways may be illegal. Installation of any of these parts may void your factory warranty. In addition, the high performance parts may produce more power than the bike was originally intended for. In other words, use at your own risk.!!!! We make no warranty to products distributed, expressed or implied, including and without limitation any warranties or merchantability and fitness for a particular purpose. We will pass on all warranties made by the manufacturer (if any) who has the sole responsibility for performing such warranties. The manufacturer shall be solely responsible for any damage to person or property arising from the design, manufacture and testing of its products, and ScootsUSA accepts no liability for such damages and shall not be liable for indirect or consequential damages. Riding a motor scooter can be dangerous. Riding a really fast motor scooter can be really dangerous. Always wear a helmet. Have fun!

Release of Liability.
Purchaser acknowledges and agrees that any purchase of products from ScootsUSA is at your own risk and that none of the owners, managers, or employees shall be held liable for any direct, incidental, consequential indirect, or punitive damages, or any other losses, cost, or expenses of any kind (including legal fees, expert fees, medical fees, or other disbursements) which may arise, directly, or indirectly from the use of any of our products.
Purchaser herewith acknowledges:
A) ScootsUSA assumes no liability for any misuse of any of its transportation products. B) Under this liability agreement ScootsUSA shall have no obligation and the purchaser shall have no remedy against ScootsUSA, its officers, agents or assigns for any damages, including without limitation, incidental, consequential, special, or punitive damages arising from direct or indirect injury to person or property, or any other loss, whether or not occasioned by negligence, or otherwise, on the part of ScootsUSA. C) Purchaser acknowledges that there is an inherent risk in the operation of motorcycles, bicycles, mopeds, and all ScootsUSA transportation products, and herewith assumes the risk of any injury arising from operation of any ScootsUSA transportation product. Original owner will indemnify and hold ScootsUSA harmless and will take full responsibility for conveying all safety warnings, instructions, and warranty if the unit is sold, lent, or otherwise transferred to other persons and will indemnify ScootsUSA from any claims against it for the original owner's failure to do so. |
